Welcome to NetGlu! These Terms of Use ("Terms") govern your access to and use of NetGlu’s websites, services, and applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

By accessing or using NetGlu, you confirm your acceptance of these Terms and agree to be legally bound by them. If you do not agree with these Terms, please do not use our Services.

You may be required to register with NetGlu to access certain services or areas of the site. Please notify NetGlu immediately of any unauthorized use of your password or account or any other breach of security.

NetGlu reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that NetGlu shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

5. Conditions of Use

5.1 User Conduct

You are solely responsible for all code, video, images, information, data, text, software, music, sound, photographs, graphics, messages, or other materials ("content") that you upload, post, publish or display (hereinafter, "upload") or email or otherwise use via the Service.

5.2 Appropriate Content and Behavior

You agree not to use the Service to upload, post, email, or otherwise transmit any content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

In addition, you must abide by NetGlu’s policies as stated in these Terms and the NetGlu policy documents listed below (if applicable to your activities on or use of the Service).

6. Content Submitted or Made Available for Inclusion on the Service

6.1 NetGlu Does Not Claim Ownership of Your Content

NetGlu does not claim ownership of the content you place on your NetGlu profile. However, by posting Content to any public area of the Service, you automatically grant, and you represent and warrant that you have the right to grant, to NetGlu an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such information and content.

6.2 Content Responsibility

The Service may contain links to other websites or resources. You acknowledge and agree that NetGlu is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.

7. Intellectual Property Rights

7.1 Respect for Intellectual Property

You acknowledge that NetGlu and its licensors own all rights, titles, and interests in and to the Service and all hardware, software, and other items used to provide the Service, other than the content you provide. Use of the Service does not grant you any ownership in or to any aspect of the Service.

7.2 Copyright Infringement

NetGlu respects the intellectual property rights of others and expects users of the Services to do the same. We will respond to clear notices of alleged copyright infringement.

8. Termination and Account Cancellation

8.1 Termination by NetGlu

NetGlu may terminate or suspend your access to or ability to use the Service immediately, without prior notice or liability, for any reason or no reason, including breach of these Terms.

8.2 Termination by User

Users may terminate their account and stop using the Service at any time. To terminate your account, please follow the instructions on NetGlu.

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

NetGlu and our affiliates make no representations or warranties of any kind about the Services. The Services are provided "As Is," without warranty of any kind, either express or implied.

9.2 Limitation of Liability

In no event will NetGlu, its affiliates, employees, licensors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

10. General Terms

10.1 Governing Law

These Terms shall be governed by the laws of the jurisdiction where NetGlu is established, without regard to its conflict of law principles.

10.2 Entire Agreement

These Terms constitute the entire agreement between you and NetGlu regarding the use of the Service, superseding any prior agreements between you and NetGlu relating to your use of the Service.

10.3 No Waiver

NetGlu’s failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

10.4 Severability

If any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
